1. The Service
Fog Off LLC ("Fog Off," "we," "us") provides residential and commercial mosquito fogging and pest control services in the 28205 zip code area of Charlotte, North Carolina. By booking a service or submitting our contact form, you agree to these terms.
2. Service Area
Fog Off currently serves zip code 28205 only, including Plaza Midwood, Belmont, Chantilly, Villa Heights, and Commonwealth neighborhoods. We reserve the right to decline service outside our designated service area.
3. Scheduling & Appointments
All appointments are confirmed via text message. Your appointment is considered confirmed once you receive a confirmation text from Fog Off and complete payment via the provided Stripe payment link.
We reserve the right to reschedule appointments due to weather conditions, equipment issues, or other circumstances beyond our control. We will notify you by text as soon as possible in these cases.
4. Cancellation & Refund Policy
Cancellations must be made at least 24 hours before your scheduled appointment. Cancellations made less than 24 hours before the scheduled service time are non-refundable. No exceptions.
To cancel, simply text us at our service number. Your cancellation is confirmed when you receive a reply from us acknowledging it.
- Cancellations 24+ hours before service — full refund or credit applied
- Cancellations less than 24 hours before service — no refund
- No-shows (property inaccessible at time of service) — no refund
- Weather-related reschedules initiated by Fog Off — full credit applied to next visit
5. Subscription Plans
Monthly subscription plans (Starter Fog, Full Send, Fog Boss) are billed automatically each month. You may cancel or pause your subscription at any time by texting us directly. Cancellations take effect at the end of the current billing period.
Fog Off reserves the right to adjust pricing with 30 days written notice via text or email.
6. Re-Treatment Guarantee
If you are unsatisfied with your treatment, contact us within 5 days of service and we will re-treat your property at no additional charge. This guarantee applies to one re-treatment per service visit.
7. Chemical Application & Safety
Fog Off uses EPA-registered products applied by a licensed North Carolina Pesticide Applicator (Category 7B). You agree to follow all safety instructions provided at time of service, including keeping pets and children off treated areas for the recommended period (typically 30 minutes after application).
You are responsible for notifying Fog Off of any known allergies, sensitivities, or health conditions prior to service. We are not liable for adverse reactions resulting from failure to disclose this information.
8. Property Access
You agree to provide Fog Off with reasonable access to your property at the scheduled service time. This includes ensuring gates are unlocked, dogs are secured indoors, and any relevant access codes are provided in advance.
9. SMS Communications
By submitting our booking form and checking the SMS consent box, you expressly consent to receive text messages from Fog Off regarding:
- Service appointments, confirmations, and reminders
- Payment links and billing updates
- Account updates and service notifications
- Seasonal promotions, special offers, and referral program updates
- Neighborhood-specific mosquito alerts and service recommendations
Message frequency varies. Message and data rates may apply. Reply STOP at any time to opt out of all messages. Reply HELP for assistance. Opting out of marketing messages will not affect transactional service messages unless you specifically request it.
10. Referral Program
Fog Off's referral program grants a $20 credit to both the referring customer and the new customer upon the new customer's first paid service. Credits are applied to future treatments and have no cash value. Fog Off reserves the right to modify or discontinue the referral program at any time.
11. Limitation of Liability
Fog Off carries general liability insurance. Our liability is limited to the cost of the service provided. We are not responsible for indirect, incidental, or consequential damages arising from the use of our services.
12. Governing Law
These terms are governed by the laws of the State of North Carolina. Any disputes shall be resolved in Mecklenburg County, North Carolina.
13. Changes to Terms
We may update these terms at any time. Continued use of our services after changes constitutes acceptance of the updated terms. Current terms are always available at fogoff.net/legal.
